Sole Representative Immigration to the UK

This visa is for substantial trading companies who have their headquarters and principal place of business outside the United Kingdom and who have no branch, subsidiary or other representative in the United Kingdom. The company should intend to establish and operate a registered branch or wholly owned subsidiary of that overseas company in the United Kingdom.

This visa is designed for a senior employee with full authority to take operational decisions on behalf of the overseas company for the purpose of representing the company in the United Kingdom. This visa is not designed for owner-managers or entrepreneurs. The rules prohibit the candidate from owning a majority or a controlling interest in the company.

This visa has work restrictions whereby people can not take employment beyond establishing a branch in the United Kingdom for the company.

These visas are normally granted for an initial period of one year. The visa can be extended in the United Kingdom one month prior to the visa expiry date for up to 3 years. After 4 years continuous stay in the United Kingdom on this visa you may apply for a settlement visa.

There are some basic requirements of the visa you must satisfy if you are to be considered for the sole representative visa to the United Kingdom.

These are:

  • You have been recruited and taken on as an employee outside the United Kingdom as a representative of a company which has its headquarters and principal place of business outside the United Kingdom and which has no branch, subsidiary or other representative in the United Kingdom
  • You seek entry to the United Kingdom as a senior employee with full authority to take operational decisions on behalf of the overseas firm for the purpose of representing it in the United Kingdom by establishing and operating a registered branch or wholly owned subsidiary of that overseas company
  • You are not a majority shareholder in that overseas firm
  • You have enough money to support and accommodate yourself without recourse to public funds
  • The company must be a genuine existing enterprise, which has been established for at least 12 months
