Nature of Visa
Entrepreneur category visa
is open for applicants with past business
and management experience.
An individual may apply for
a Permanent Resident Visa under an entrepreneur
category, along with his family.
Requirements
- He has substantially good
net worth. Net worth of the applicant may
include the properties valued at current market
prices, investments in shares and stocks or
savings that can be demonstrated through balances
against fixed deposits and saving accounts.
These assets and savings may be in the name
of either the applicant and / or spouse and
/ or children. Those candidates meeting the
net worth requirements of around Canadian
dollar 3,00,000 are likely to be preferred
(one Canadian dollar is equal to a approx
INR - 30).
- The applicant
should be able to demonstrate the business
/ management experience through supporting
documents.
- Such supporting
documents may include the finance statements
related to the business including balance
sheets/profit & loss account and business
tax returns.
- It is expected
that the applicant has reasonably good English
communication skills.
- The Visa's
are issued for the entire family and the
applicant is expected to start up a Canadian
business within an identified time frame.
Currently the time frame is around two years
and may be increased to three years in near
future.
- There is
not maximum age limit criteria applicable
for entrepreneur category applicants.
- It is normally
expected that the applicant can demonstrate
his earnings through personal tax returns
filed in the recent past as also for the
past business experience.
- The business
being run in India may be Proprietary, Partnership
or Corporate in nature.
- The applicant
should be able to make required investments
in Canadian business in post landing in
Canada.
- It is expected
that the Canadian business initiated by
the applicant will at least appoint one
Canadian resident or citizen.
To Qualify a successful
Entrepreneur Class applicant is one who has:
- Managed a qualifying
business and has controlled a percentage
of equity of the qualifying business for at
least two years in the period beginning five
years preceding the application; and
- Possesses a personal net
worth of C$300,000 legally obtained (assets
may comprise of inheritances as well as the
assets of a spouse/common-law partner/same-sex
partner) and
- Undertakes to control at
least 33% of the equity of a qualifying
Canadian business and provide active
and ongoing management of the qualifying Canadian
business that will create at least one incremental
full-time job (37.5 hours per week or more)
for Canadian citizens or permanent residents,
other than the entrepreneur and their family
members. This condition must be fulfilled
for a period of one year within the period
of three years after the day on which the
entrepreneur becomes a permanent resident.
This is known in the industry as meeting entrepreneurial
terms and conditions.
With respect to the first condition
above, the qualifying business must meet any
two (2) of the following criteria:

With respect to the third condition
above, the Entrepreneur Class applicant must
operate a Canadian qualifying business
for a period of at least one year within the
period of three years after the day on which
the entrepreneur becomes a permanent resident.

Failure to establish a Canadian
qualifying business can result in the deportation
of the applicant and landed dependants.
